GENERAL CONDITIONS OF CONTRACT/TOUR PACKAGE
1) OPENING FEE
A registration fee is charged for each flat rental, the amount of which varies according to the type of flat rental.

2) PAYMENTS
At the time of booking, the Client shall pay the seller agency a deposit of 25% of the total amount of the stay, in addition to additional costs (ferry, opening fee, insurance, if applicable).
The balance by bank transfer must be paid 15 days before the start of the trip/stay.
For bookings made less than 15 days before the start of the trip/stay, the Client must pay the full balance. If the Client wishes to pay the balance upon arrival, the balance can be paid in cash or by cheque. In the event of non-payment to the Seller Agency of the services booked within the above-mentioned terms, the Seller Agency shall have the right to decide, at its sole discretion, to invalidate any document/travel ticket previously issued and to cancel the services booked and/or to take legal action to obtain payment for the same.
In the case of the non-refundable rate, the Client shall pay the full amount upon confirmation of the booking.
3) RESERVATIONS
Easyelba will send the customer a “quote option” containing: a detailed description of all the services offered, the price of these services, the amount of the deposit and a copy of the “General Terms and Conditions”.
The booking will be considered as completed upon written confirmation from Easyelba to the Travelling Customer that the deposit has been received. Payment of the deposit automatically implies confirmation of receipt, reading and acceptance of these “General Terms and Conditions” by the Traveller.
4) ORGANISER CHANGES
The information, descriptions, promotions, offers, seasonality and rates shown on this website are to be considered accurate, except in the case of errors, omissions and updates. Easyelba reserves the right to communicate any changes at any time. Should it become necessary due to force majeure, Easyelba reserves the right to change the accommodation and/or place of stay. The traveller must inform Easyelba in writing of his decision to withdraw or use the alternative package within and no later than 2 days of receipt of the alternative proposal. If the customer does not accept any changes, Easyelba will be obliged solely and exclusively to refund the sums collected within 7 working days of the customer’s notification.
5) CUSTOMER CHANGES
For every single change requested by the Travelling Customer, after the booking has been made, a lump sum of Euro 30.00 per case plus any penalties will be charged.
6) CESSION
If a traveller is unable to make use of the trip booked, he may transfer his booking to a person who meets all the conditions required for the trip. The assignor must notify Easyelba by registered letter with advice of receipt, which must be received no later than 4 working days before the start of the holiday, stating the particulars of the assignee. The transferor and the transferee are jointly and severally liable for the payment of the price as well as for the additional expenses arising from the transfer and quantified at €30.00.
7) WITHDRAWAL CANCELLATION
In the event of cancellation of the travel contract, the conditions according to the fare selected at the time of booking will apply.

8) CONDITIONS FOR RESERVATIONS IN FLATS
The property is rented out as a temporary and secondary residence during the summer holiday period. The parties agree that this contract is concluded expressly for this purpose, to the exclusion of any other. The contract will be registered exclusively in the name of natural persons and not in the name of VAT subjects unless previously agreed.
PRICES
Unless otherwise indicated, the prices indicated are per flat and for the period indicated. They include: the rental of the premises with relative services, furniture, crockery and kitchen utensils and accessories essential for a short holiday stay, VAT. Also included are the consumption of water, electricity and gas.
The prices do NOT include linen, final cleaning, the cost of any additional beds, and opening fee, any tourist tax and anything else not expressly indicated as included or free of charge.
DELIVERIES
Unless otherwise indicated, the flats will be delivered from 4.30 p.m. to 7.00 p.m. on the day of arrival and must be returned by 9.30 a.m. on the day of departure in excellent conditions of cleanliness with particular reference to the kitchen and bathrooms. If, for reasons of force majeure, the arrival should be delayed, it is necessary to inform the Agency.
Under no circumstances shall the accommodation be occupied by more adults and children than the number for which the flat is intended.
CAUTION
On arrival a deposit for any damage must be paid to the agency, unless otherwise indicated, which will be returned at the end of the stay after inspection of the flat and subject to deduction for reimbursement of damages caused or for failure to clean the kitchenette or to properly dispose of waste during the period of stay. The amount of the deposit is indicated on each accommodation sheet.
ANIMALS
Animals are allowed, if accepted in the relevant establishment, only with express authorisation.
CONDITIONS FOR HOTEL BOOKINGS PRICES
The prices in the tables shown on the website are per person in a double room with services on the basis of the treatment indicated, with the relative supplements and reductions (for additional beds, the years are understood to be before the age of majority) and inclusive of VAT and service charge. The treatment chosen must be the same for all occupants of the room. Extra meals purchased individually may have a higher price, any meals not taken will not be refunded. Prices do not include drinks, tips, extras in general, any tourist tax and anything else not expressly indicated as included or free of charge.
CONSEGNE HOTEL
Unless otherwise indicated, rooms will be delivered from 15.00 to 19.00 on the day of arrival and must be returned by 09.00 on the day of departure. If, for reasons of force majeure, the arrival should be delayed, it is necessary to inform the management of the accommodation facility.
CLASSIFICATION OF ACCOMMODATION HOTELS/RESIDENCES
The classifications and categories of hotel accommodation are assigned according to the regulations in force by the competent local authorities. In the case of non-hotel accommodation facilities or in the absence of an official classification, Margherita Viaggi will assign its own subjective evaluation based on the quality standards present.
9) COMPLAINTS
In the event of any complaints relating to the services received, in order that there may be evidence of the problem complained of and that it may be promptly remedied, the customer must contact Easyelba immediately. The customer may also submit a written complaint by registered letter to Easyelba no later than 10 working days after the end of the services indicated in the travel contract.
10) RESPONSIBILITY
The sale of tourist packages/services dealt with on this website is governed by these General Conditions and by the provisions of the International Convention on Travel Contracts (C.C.V.) ratified and implemented by law no. 1084 of 27/12/1977 – as applicable – as well as by the Consumer Code as per Legislative Decree no. 206 of 06/09/2005 (articles 82-100) and its subsequent amendments. Pursuant to articles 85-86 of Legislative Decree no. 206 of 06/09/2005, the Seller Agency that makes the reservation of tourist services on behalf of the Travelling Client, is obliged to sign a Travel Contract with the Travelling Client that describes in detail all the services booked and that specifies unequivocally that the Travelling Client has read, accepted and received a copy of the General Conditions reported on the Margherita Viaggi website. Failure to fill out or incomplete signing of the Travel Contract will relieve Margherita Viaggi of any responsibility for non-fulfilment of the obligations imposed on the Seller Agency and the Consumer. Margherita Viaggi cannot be held responsible for damages and/or inconveniences caused by: strikes, suspensions or delays due to adverse weather conditions, natural disasters, public works, road accidents, lack of water or electricity, interruptions in communications and transport. These or similar cases cannot be attributed to the organiser, the carriers or the service providers. Any additional costs incurred by the customer due to these causes will not be reimbursed, nor will any services that are lost or unrecoverable due to these causes. Furthermore, the organiser cannot be held responsible for any damage that may result from autonomous initiatives taken by the traveller during the execution of the trip. Luggage travels at the risk of the client and Margherita Viaggi will not be held responsible for any theft, loss or damage.
11) DUTY OF CARE
The organiser is obliged to provide the measures of assistance to the traveller imposed by the criterion of professional diligence, exclusively with reference to the obligations incumbent on him.
12) LIABILITY INSURANCE
In order to cover the risks deriving from participation in travel or accommodation programmes and to guarantee the exact fulfilment of the obligations assumed towards clients, Margherita Viaggi has stipulated a “Flat Premium” Civil Liability policy for Travel Organisers and Intermediaries with the insurance company Mondial Assistance. Policy number 190610, in accordance with art. n.86 L.R.T. n.42 of 23/03/2000 and n. 14 of 17/01/2005.
13) GUARANTEE FUND
Pursuant to Art. 100 of Legislative Decree no. 206/2005, a guarantee fund has been set up at the Ministry of Productive Activities to which all travellers can apply in the event of insolvency or bankruptcy of the seller or organiser. The modalities of intervention of the fund are established by a decree of the Ministry of Productive Activities (art. 100 L.D. 206/2005).
14) COMPETENT COURT
The Court of Livorno shall have exclusive jurisdiction over any disputes and controversies.
15) CONSENT TO THE PROCESSING OF PERSONAL DATA
All personal data will be processed in full compliance with the provisions of Legislative Decree 196/2003 and used exclusively for the completion of the formalities involved in making reservations and for the dispatch of our advertising material.
Customers have the right to modify, integrate and ask for the cancellation of their personal data.
